Concourt to hear school language case
The Mpumalanga Education Department will apply to the Constitutional Court on Thursday for leave to appeal against a ruling that Hoerskool Ermelo could return to its single-medium Afrikaans status.
The Supreme Court of Appeal (SCA) in Bloemfontein ruled in March that the school governing body – and not the Education Department – had the power to determine the language policy of a school.
The SCA ruling came after the school was unsuccessful in a high court bid to review the Department’s decision to take that power away from the school governing body.
Now the Head of the Education Department in Mpumalanga and the Minister of Education are appealing to the Constitutional Court to set aside the order and judgement of the SCA.
The saga started in January 2007 when the school’s governing body said it would not change its Afrikaans language policy to accommodate some pupils who wanted to be taught in English. - Sapa
